TERMS & CONDITIONS

Background

This agreement is between the Contractor and Sally Orchard of Orchard Bridal Artists (OBA). By signing this agreement, the Contractor agrees to provide services as outlined below, and TY agrees to engage the Contractor under these terms

 

1. Services Provided

1.1 Scope of Services: The Contractor will provide hair and/or makeup services for brides and bridal parties, as per bookings confirmed by OBA

1.2 Additional Tasks: Other tasks may be assigned as mutually agreed between OBA and the Contractor.

 

2. Term of Agreement

​

2.1 Start Date: This agreement begins on the date signed and remains in effect until terminated by either party.

2.2 Termination Notice: Either party may end the agreement with 30 days’ written notice.

2.3 Breach of Agreement: A material breach allows the non-defaulting party to terminate the agreement immediately.

2.4 Mutual Termination: The agreement may also be ended at any time by mutual consent.

2.5 End of Obligation: Contractor responsibilities end upon termination, unless otherwise specified.

 

3. Confidentiality

 

3.1 Confidential Information: Any private or sensitive information about OBA that is not publicly available and could cause harm if shared.

3.2 Non-Disclosure: The Contractor must not share or use confidential information unless authorised by OBA or required by law. This obligation remains in effect indefinitely, even after termination.

 

4. Professionalism

 

4.1 Representation: Contractors must always represent OBA with professionalism by:Maintaining a smart and appropriate appearanceArriving on time Delivering exceptional service and client experience

4.2 Cancellations:

 

If the Contractor cancels a job at short notice:

  • They must find a suitable, approved replacement artist.

  • They will not receive payment for the cancelled job.

  • If the job cannot be reassigned and OBA must cancel on the client, the Contractor will be required to pay £100 in compensation to cover the client’s deposit and admin costs. This ensures the bride is fairly compensated, and helps protect the TY brand and team reputation.

4.3 Client cancellations

  • Any Cancellations within 12 weeks of the event: A 50% charge of the final invoice will apply if any cancellations occur within 12 weeks of the event date, payable 7 days before the event. (or at the time if complete cancellation)

  • Cancellation within 4 weeks of the event: Full payment is still required if any of the booking is cancelled within 4 weeks of the wedding date. payable 7 days before the event. (or at the time if complete cancellation)

  • You (The contractor) will receive this cancellation payment minus the 30% commission payment.​​

5. Code of Conduct

 

5.1 Bookings: Any client enquiries must be directed back to OBA. Booking independent work from a OBA job is a serious breach and may result in termination.

5.2 Social Media: Contractors may promote their work on personal platforms but must clearly credit OBA in the caption (not just a tag).

5.3 Advertising: OBA client imagery must not be used for personal promotional material (online or offline) without OBA’s prior consent.

 

6. Content Terms

 

6.1 Tagging & Attribution: When posting content from a OBA job (e.g. previews, weddings, shoots), please do not tag OBA supporting artists pages individually. Instead, tag OBA team and then just list the team members involved in that job.

 

6.2 Team Promotion: Contractors are encouraged to capture and share high-quality images/videos from jobs. These should be sent to OBA for use across OBA social platforms to promote both the individual and the team.

 

6.3 Content Use: Content from OBA jobs—including previews, portfolio days, or styled shoots—must not be used within other teams or to promote other teams or businesses. Likewise, OBA will not use content from other teams for its own marketing.

7. Administration

 

7.1 Admin Responsibilities: OBA handles all bookings, client communication, and invoice processing.

7.2 Contractor Admin: Contractors are only expected to:

 

  • Arrange any requested consultation calls

  • Confirm the preview date with the bride

  • Create and manage the prep schedule for the wedding morning

 

7.3 Diary Management: Contractors must manage their own schedule and ensure availability aligns with bookings provided by OBA.

8. Payment

 

8.1 Commission: OBA retains a 30% commission from all jobs assigned to the Contractor.

8.2 Invoicing: Contractors should submit invoices by the last working day of each month.

8.3 Payment Terms: OBA will pay invoices within 30 days of receipt. Payment will not be processed without an invoice.

8.4 Tax: Contractors are responsible for managing their own income tax and National Insurance contributions.

 

9. Independent Contractor Status

 

9.1 Legal Status: The Contractor is an independent contractor, not an employee of OBA. This agreement does not form a partnership, joint venture, or employer-employee relationship.
